Police examine the issue of abuse of power based on TIAC application
Based on the application of Transparency International Anti-corruption Center filed to RA Prosecutor Generals Office, Yerevan City Department Central Division of General Department of Investigations of RA Police prepares materials. They refer to exposing conflict of interest situation and abuse of official authorities or misfeasance with regard to direct involvement of Narek Sargsyan, Chief Architect of Yerevan in Yerevan City Center construction that resulted in destruction of monuments of history and culture.
As a reminder, Narek Sargsyan was Chief Architect of Yerevan in 1999-2004 and from 2011 to present. Large-scale construction in Yerevans Center was launched when he was in office with his direct participation. Moreover, it was "Narek Sargsyan Architectural Studio" LLC that was involved in its construction-design work. In particular, that company designed the hotel complex to be built in the area of the Armenian Society for Cultural Relations and Cooperation with Foreign Countries (AOKS) in 3 Abovian Street and in its vicinity. It means that AOKS building and the area in its vicinity are under a threat to be demolished. By RA Government decision, they are considered as monuments of republican significance.
It should be noted that RA Prosecutor Generals Office discovered destruction of monuments of history and culture in Yerevan City still in 2005, however no one incurred liability in the manner prescribed by the Armenian legislation, whereas the Criminal Code of Armenia stipulates liability for destruction or damage of monuments of history and culture.
In 2008-2011 in his tenure of Chief Architect and Deputy Minister of Urban Development N. Sargsyan combined his office and business and was involved in design of a number of buildings that were constructed or were in the process of construction. He continued working in the same style since 2011 by working as Chief Architect of Yerevan yet again.
Chief Architect of Yerevan is considered to be public servant. According to article 24 of RA Law on Public Service, "Public servant and high ranking official shall not have the right to be personally engaged in entrepreneurial activity."
Given the above-mentioned facts there are reasonable doubts on manifestation of patronage and possible abuse of power.
