Lawyer Heriknaz Tigranyan of Transparency International Anti-corruption Center has been protecting the interests of Georgy Mkrtchyan, legal successor of aggrieved party in a criminal case since March 2010. The wife of the aggrieved person was taken to reanimation department of Erebuni Medical Center on August 1, 2008, where she passed away the next day. A criminal case was initiated by Erebuni Investigation Division of RA Police General Investigation Department on May 19, 2009, based on Point 2 in Article 130 of the Criminal Code of Armenia, failure to implement or improper implementation of professional duties by medical and support personnel, which caused the death of the patient.

There were contradictory conclusions regarding her death as a result of forensic medicine examinations during pre-trial. By the way, the final and according to the pre-trial body, credible conclusion came from a commission set up by the order of the Minister of Healthcare Harutun Kushkyan. Such circumstance cast doubt on the impartiality of the conclusion considering the Minister's direct relation with Erebuni Medical Center.

On December 19, 2009 by the decision of the investigator the criminal proceeding was discontinued for lack of corpus delicti. The decision was appealed by G. Mkrtchyan and his representative H. Tigranyan in court, however the complaint was rejected based on the decisions of General Jurisdiction Court of Erebuni and Nubarashen administrative districts (Judge Ye. Yesoyan) and by Criminal Court of Appeal of Armenia (Judge A. Petrosyan), so that investigator's decision on discontinuing criminal proceeding for lack of corpus delicti remained in legal effect.

The Court of Cassation of Armenia redressed the appeal of the legal successor of the aggrieved party and his representative and sent the case to General Jurisdiction Court of Erebuni and Nubarashen administrative districts for a new examination.

As a result of new examination of the case, by its decision on June 15, 2011, the Court (Judge Vladimir Grigoryan) recognized the complaint of legal successor of the aggrieved party Georgy Mkrtchyan and his representative Heriknaz Tigranyan as grounded and redressed it, overruling the decision of senior investigator, which means restarting criminal proceedings.
